Payment is expected at time of viewing. If you will be making payments, we will set up automatic payments through our payment processor. Finished portraits take 2-3 weeks to process from your viewing date. If Client is unable to make the scheduled viewing Infinity Image & Design is not responsible for any delay in delivery of the order. Infinity Image & Design does not start working on any orders until 50% of order total has been received. If payment has not been received in full by the availability date of your order, it will be held until full payment is received. Because our price list is updated periodically, Infinity Image & Design guarantees all prices from the time you book your session until 10 days after your photo shoot. Any orders place 10 days after your session are subject to the current price schedule.
All images before viewing will undergo semi-retouching and an overall softening filter. This is includes correction of lighting, sharpening, color correction, and a general overall skin softening filter (great for subjects with little to no skin blemishes). Full basic retouching includes removal of blemishes and wrinkles, softening of circles and bags under the eyes, skin softening and the whitening of teeth and eyes. All other retouching is considered premium retouching and includes, but is not limited to, correction of hair/makeup, environmental effects, clothing, reflections in glasses, opening of closed eyes, removal/insertion of people or objects, head swaps, etc. Premium retouching or extensive touch-ups will incur an additional fee of $5.00-$30.00. Upon delivery of prints and/or digital files, Client(s) accept all responsibility for archiving and protecting the photographs/digital media. Infinity Image & Design does not permanently archive image files. Infinity Image & Design is not responsible for the life span of any photography and/or digital media provided, or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is the responsibility of the Client(s) to make sure that digital files are copied to new media as required.
Upon completion, photographer will notify Client(s) their order is ready or have it shipped if shipping has been paid for. If shipping was not arranged and Client(s) fails to pick up their order within 15 days, Infinity Image & Design will not be responsible for damage caused by storing Client(s) ordered products. This agreement is valid for six months after the photo shoot and if Client(s) fails to complete their purchase and pick up their order, Infinity Image & Design will consider this transaction to be completed in full and have no further obligation. If order has not been paid in full, the account will be sent to collections with collection fees added to the original order amount. If items have been damaged in shipment, Infinity Image & Design will re-send any damaged items after verification has been made and damaged products have been returned. Infinity Image & Design is not liable for a delay due to damaged or lost goods.
The session fee is due upon booking to reserve your appointment and is non-refundable. If you’re unable to make your scheduled appointment you may reschedule another available date for half of your session fee. If you are scheduled for an outdoor shoot and it’s raining, hailing, snowing, or there is lightning your shoot will be rescheduled without penalty or you may choose to do your session inside. We do not reschedule sessions due to overcast or cloudy weather. If you wish to shoot on a sunny day, you may reschedule for half of your session fee. Once Client(s) has reviewed their images and placed their order, 50% of the total order is due before processing of the order will start. The remaining balance is due when the order is delivered. If payment arrangements have been made the details will be described on the attached Payment Plan form. If Client(s) fails to contact Infinity Image & Design to arrange pick up of their order that hasn’t been fully paid, or to arrange shipment (additional charges will apply) within 15 days of notification that order is finished, the account will be turned over to a collection agency. Client will pay the full amount remaining for their order plus a finance charge and any fees incurred for use of a collection agency. A finance charge of 5% will be added the first of the month to all delinquent accounts starting the first day after the 15 day grace period. Any breech of this Agreement will constitute a reason for non-completion of the order with no liability to Infinity Image & Design or it’s Assignee’s and the loss of all payments made under this contract. All payments made are non-refundable.
Infinity Image & Design’s Payment Plan is devised to help take the financial stress out of paying for photos all at once. Payment schedules are based upon total purchase price. A deposit of $25 is due when the order is placed with the remaining balance divided out across the term of Clients‘ payment schedule. Once committed to a payment plan, payments are to be made monthly using a credit or debit card. If Infinity Image & Design is unable to obtain payments as scheduled in this Agreement, Clients’ account will be turned over to a collection agency. Client(s) will then be responsible for the full amount remaining for their order plus above stated finance fees and any fees incurred for the use of a collection agency.
Client(s) agrees to purchase prints directly from Infinity Image & Design unless a digital copy of the image has been purchased. Client(s) agrees not to scan, copy or reproduce images in any manner without written permission. Client will be required to pay for a digital copy of the image(s) based on the current prices at time of discovery. If digital files are purchased, a written release will be supplied with those files. The release grants Client(s) the right to reproduce the images provided for their personal use only and does not allow the photos to be altered, sold or published. Client(s) further agree not to supply images to any third parties. For best results, Client(s) with high-resolution files should order their prints through a reputable lab. Infinity Image & Design is not responsible for the outcome of prints that are not ordered directly from us.
Infinity Image & Design retains the ownership and copyright of all images. Client(s) may choose to purchase a digital copy of their images for the stated cost listed on our current price sheet, however Infinity Image & Design will still remain the owner of all images taken. Client(s) understand that any duplication of any photos that have not been issued a copyright release form is a violation of U.S. Copyright Law (USC Title 17). It is illegal to copy, scan, reproduce, alter in any manner, including but not limited to electronics scanning via personal scanner or reproduction via a photo lab, self service kiosk, or post online in forums or on websites without the written permission of Infinity Image & Design. Violators of this federal law will be subject to its civil and criminal penalties. Client(s) are hereby given permission to make personal copies of images from CD’s or DVD’s that were given to Client(s) by Infinity Image & Design, for their own use in E-mail or on personal web pages as long as full credit is given. In addition, Infinity Image & Design is entitled to all monies gained through unauthorized use or sale of images. Infinity Image & Design reserves the right to use images for advertising, display, publications, or other purposes needed to help promote business.
LIMITATION OF LIABILITY
The limitation of liability shall apply to any photographic materials that are damaged in processing, lost through camera or computer malfunction, lost in the mail, otherwise lost or damaged without the fault on part of the photographer, or failure to deliver photos within the time stated in this contract. In the event Infinity Photography & Design fails to perform for any other reason, Infinity Image & Design shall not be liable for any amount in excess of the money the Client(s) has paid. Client(s) agree that in the event of a misunderstanding, they give up their right to take this Agreement before a court. All disputes shall be handled outside a courtroom through private meetings or through the help of an Arbitrator. Any fees incurred as a result of a dispute shall be the responsibility of the party that brought forth the dispute.
